Terms of Service

These Terms of Service ("Terms") govern your use of Claire, a WhatsApp-based AI productivity assistant operated by Claire AI ("the Company", "we", "us", "our"), based in Ireland.
By sending a message to Claire on WhatsApp, you agree to these Terms. If you do not agree, please stop using the service.
1. Service Description
Claire is an AI assistant that helps you manage your email, calendar, and tasks through WhatsApp messages. Claire can:
- Read and summarise your emails
- Check and manage your calendar events
- Manage your task lists
- Provide daily briefings and reminders
Claire connects to your existing accounts (Google, Microsoft) via OAuth to access these services on your behalf.
2. Eligibility
You must be at least 16 years old to use Claire. By using the service, you represent that you meet this age requirement.
3. Account and Access
- Your Claire account is identified by your WhatsApp phone number
- You are responsible for all activity that occurs through your WhatsApp number
- You may connect third-party accounts (Google, Microsoft) to Claire. By doing so, you authorise Claire to access those accounts on your behalf, limited to the permissions you grant during the OAuth flow
- You can disconnect any connected account at any time by messaging Claire
4. Acceptable Use
You agree not to:
- Use Claire for any unlawful purpose
- Attempt to access other users' data or accounts
- Send abusive, harmful, or harassing messages to Claire
- Attempt to manipulate, exploit, or reverse-engineer Claire's AI capabilities
- Use Claire to send spam or unsolicited messages through connected accounts
- Exceed reasonable usage limits or attempt to circumvent rate limiting
- Resell or commercially redistribute access to Claire
5. AI-Generated Content
Claire uses AI language models to process your requests and generate responses. You acknowledge that:
- AI responses may contain errors. Claire may misinterpret requests, provide inaccurate summaries, or make mistakes. Always verify important information directly in your email, calendar, or task applications.
- Claire is not a substitute for professional advice. Do not rely on Claire for legal, medical, financial, or other professional guidance.
- Actions are your responsibility. When Claire performs actions on your behalf (e.g., creating calendar events, managing tasks), you are responsible for reviewing and confirming the results.
6. Connected Account Actions
- Read-only by default. Claire initially operates in read-only mode for connected accounts.
- Write operations require explicit confirmation. When write operations are available (e.g., sending emails, creating events), Claire will ask for your confirmation before executing them.
- We are not liable for third-party service issues. If Gmail, Outlook, or other connected services experience downtime or errors, Claire's functionality may be affected. We are not responsible for the availability or accuracy of third-party services.
7. Pricing and Billing
- Claire offers both free and paid tiers
- Free tier usage is subject to daily and monthly limits
- Paid features and pricing will be communicated clearly before any charges apply
- We reserve the right to modify pricing with 30 days' notice
8. Data and Privacy
Your use of Claire is also governed by our Privacy Policy. Key points:
- We store conversation history, connected account tokens (encrypted), and usage metadata
- Your data is stored in the EU (Google Cloud, europe-west1)
- OAuth tokens are encrypted with Google Cloud KMS
- The AI model never sees your raw credentials
- You can request data deletion at any time
9. Intellectual Property
- Claire and its underlying technology are owned by Claire AI
- You retain ownership of your personal data and content from your connected accounts
- We claim no ownership over your emails, calendar events, tasks, or other personal content
10. Service Availability
- We aim to provide a reliable service but do not guarantee 100% uptime
- Claire depends on third-party services (WhatsApp, Google Cloud, Vertex AI) that may experience outages
- We may perform maintenance that temporarily affects availability
- We will make reasonable efforts to notify you of planned downtime
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Claire is provided "as is" and "as available" without warranties of any kind, whether express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim arising from your use of Claire shall not exceed the amount you have paid us in the 12 months preceding the claim, or EUR 50, whichever is greater
- We are not liable for any actions taken by the AI that you did not explicitly confirm, or for errors in AI-generated summaries or content
12. Termination
- You may stop using Claire at any time by ceasing to send messages
- You may request account deletion by messaging Claire "delete my data" or emailing privacy@heyclaire.ai
- We may suspend or terminate your access if you violate these Terms or engage in abusive behaviour
- Upon termination, we will delete your data in accordance with our Privacy Policy retention schedule
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via WhatsApp message at least 14 days before they take effect. Continued use of Claire after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or your use of Claire shall be subject to the exclusive jurisdiction of the courts of Ireland.
